To Our Local Zoning Officials: A number of events have led to the consideration of zoning restrictions for antennas in residential districts across the nation. While certainly being considered in the general inter- est of the public, these restrictions are being fashioned in such a manner that they unknowingly reduce the effectiveness of Amateur Radio. In addition, there are clearly defined federal interests and regulations which supersede local control in order to promote such services as Amateur Radio. These interests are so strong that the Federal Communications Commission has recently stated in very strong terms its concern that local zoning be structured to permit continued advancement of this communications service. Recently Mr. Jeff Reynolds applied for a height variance, which would allow him to erect an antenna support structure in excess of current zoning regulations. After several lengthy hearings, Mr. Reynolds was granted a variance by the Zoning Board of Appeals, with the stipulation that current zoning regulations regarding antenna support structures be reviewed and revised. We the amateur radio community have formed a committee with the purpose of assisting the City of Omaha Planning Department in the revision of zoning regulations regarding amateur radio antenna support structures. Members of our committee represent the many and varied interests in Amateur Radio throughout the Omaha area. As active partici- pants in this community, we wish to offer this package of inform- ation in a constructive effort to assist in this revision process. We are convinced, as are a vast number of governmental agencies, including the FCC, that Amateur Radio presents an uncommon benefit to this community; enough so to warrant your special considerations. The following pages contain proposed changes to the current zoning regulations, a copy of the current regulations as-is, and general information regarding amateur radio and the regulations thereof.
