Incorporation
Why we incorporated:

Liability protection when we are working as an ARES unit. Unincorporated, we operate as a joint venture. If one of us gets sued (say, for an auto accident), we all can get sued. If we incorporate, the other members will be shielded by the corporation.

An unincorporated group can not own property in its own name. Legally, a corporation is considered a person in most respects, including the right to own property. For example, Search & Rescue gave us a trailer. Unincorporated ARES cannot take title to the trailer. An incorporated ARES can take title to and register the trailer. Also, as a nonprofit corporation, we save on sales taxes, etc.

We will file for a IRS 501(c)(3) charitable classification. Then, people and organizations who donate to us can get a tax deduction. Some funding sources, e.g., United Way, require tax-exempt status.
Jim Tully, Sam Musselman and Dick Grady filed incorporation papers with the Nevada Secretary of State to create a nonprofit corporation with the name: Southern Nye County Amateur Radio Emergency Service, Inc.
At our meeting on May 30, 2002 the membership approved the Bylaws.
